1. Who this applies to

These terms apply to anyone who visits the Upahaar Nepal website or places an order with us. By placing an order, you agree to these terms. If you do not agree, please do not place an order.

Upahaar Nepal Pvt. Ltd. is registered in Nepal (PAN: 622461045, Registration No. 376787).


2. Our service

We accept gift orders from customers anywhere in the world and deliver them to recipients in Nepal. You place and pay for the order — we handle the packing, wrapping, and delivery inside Nepal.


3. Placing an order

When you place an order, you confirm that:

  • The information you have provided (including the recipient's name, address, and phone number) is accurate

  • You are authorised to make the payment you are using

  • You are at least 18 years old

We will send you an order confirmation by email or WhatsApp once your order is received. This confirmation does not guarantee that the order will be fulfilled — if a product is out of stock or we cannot deliver to the given address, we will contact you and offer a full refund or an alternative.


4. Pricing and payment

All prices are listed in Nepali Rupees (NPR). Payment must be completed before your order is dispatched.

We accept payments through the methods shown at checkout. Prices include applicable taxes where required by Nepali law.

We reserve the right to correct pricing errors. If a product is listed at the wrong price, we will inform you before dispatching and give you the choice to proceed at the correct price or cancel for a full refund.


5. Delivery

We deliver across Nepal. Timelines vary:

  • Kathmandu Valley: 1-2 working days

  • Outside Kathmandu Valley: 3-5 working days

Delivery timelines start from the date of dispatch, not the date of ordering. We will notify you via WhatsApp when your order has been dispatched, and again with a photo once it has been delivered.

We are not responsible for delays caused by events outside our control — such as bandhs, natural disasters, extreme weather, or public holidays. In such cases, we will keep you informed and do our best to deliver as soon as possible.


6. Cancellations

You may cancel your order before it has been dispatched by contacting us on WhatsApp (9705195782) or email. Once an order has been dispatched, it cannot be cancelled.


7. Returns and refunds

We want you to be happy with every Upahaar. If something goes wrong, we will make it right.

You are eligible for a refund or replacement if:

  • The wrong item was delivered

  • The item arrived damaged or spoiled

  • The order was not delivered within a reasonable time beyond the stated timeline

You are not eligible for a refund if:

  • The item has been delivered successfully and is in good condition

  • The item is perishable (food, chocolates) and has already been delivered

  • The item was personalised or customised to your specifications

  • You changed your mind after the order was dispatched

To raise a concern, contact us within 24 hours of delivery via WhatsApp with a photo of the item. Approved refunds are processed within 5–7 working days to the original payment method.


8. Personalised and customised orders

Orders that include personalised gift messages, custom wrapping, or bespoke gift combinations are made specifically for you. These cannot be returned or refunded unless they arrive damaged or are incorrect.


9. Limitation of liability

We take every reasonable step to ensure your gift is delivered safely and on time. However, Upahaar Nepal's total liability for any claim related to an order is limited to the value of that order.

We are not liable for indirect losses, such as disappointment if a gift does not arrive in time for a specific occasion, unless caused by our proven negligence.


10. Intellectual property

All content on our website — including text, photos, branding, and product descriptions — belongs to Upahaar Nepal Pvt. Ltd. You may not copy, reproduce, or use it without our written permission.


11. Changes to these terms

We may update these terms occasionally. Changes take effect as soon as they are posted on our website. Continued use of our service after changes means you accept the updated terms.


12. Governing law

These terms are governed by the laws of Nepal. Any disputes will be handled through the appropriate courts or consumer protection authorities in Nepal.
